Mind League Terms and Conditions of Use

This English version is a translation of the Italian text, which is the version in force. If the two versions differ, the Italian version prevails.

1. Who we are

The Mind League app ("the App") is provided by Oglut S.r.l., Viale Tito Livio 65, 00136 Rome, Italy, VAT no. 15766701005 ("Oglut", "we", "us"). Contact: info@oglut.com.

These Terms govern your use of the App and the related services. By using the App as a guest you accept them; to complete your profile and use the social features we ask you to accept them explicitly. How we process personal data is described in the Privacy Policy, which you can find in the App (Profile → Settings) and at /privacy.

2. The service

Mind League is a collection of short brain-training games (reflexes, memory, attention, planning, reasoning), with levels, progress, leaderboards, friends and challenges between players.

Mind League is a game. Scores, levels and leaderboards are not a measure of cognitive ability, have no diagnostic or medical value and do not replace the advice of a professional. Some games use colors, sounds, vibrations and fast stimuli: if you have color vision problems, sensitivity to light or other health conditions, use the App with care and stop if you feel any discomfort.

The App is free and may show ads, never during rounds (Privacy Policy, §17). Ads do not change scores, levels, leaderboards or challenges. We may introduce paid features, including an ad-free Premium subscription, governed by additional terms that we will show you before the purchase. Games, challenges and leaderboards remain free.

Ads come from third parties. If you tap one you may leave the App, and the advertiser's terms apply to the products and services advertised: Oglut is not liable for them.

3. Beta version

During the beta the App is being tested: games, scores, levels and graphics may change, the service may be available only at certain times or be interrupted, and the data collected during the beta, including results and progress, may be reset.

4. Age requirements

Mind League is only for people who are at least 13 years old. To complete your profile you must enter your real date of birth: if it shows you are under 13 you cannot complete it. Entering a false date is a breach of these Terms and results in the account being closed.

5. Account

• Guest. The first time you open it, the App creates a guest account tied to your phone. If you uninstall the App, change phone or sign out without having linked an email, you may lose your progress.
• Profile. For friends, challenges and invites you must complete your profile with a nickname and your date of birth. The data you enter must be true. Your date of birth stays private and is never shown to other players.
• Email. You can link an email to sign in to your account again. If you use an email already linked to another account, you switch to that account and the progress of your current account is not transferred.
• One account per person. Your account is personal: you may not transfer it, sell it or use it on behalf of others. You are responsible for keeping access to your phone and your email safe.

6. Nickname

Your nickname is visible to other players. It must have 3 to 20 letters (accented letters included) or digits, without spaces or symbols, and you can change it once every 30 days. It may not:

• be offensive, vulgar, discriminatory, threatening or sexually explicit;
• impersonate another person, a public figure, Oglut or Mind League;
• contain personal data (yours or anyone else's), addresses, links or advertising;
• infringe the rights of others, for example trademarks.

We may reject a nickname or ask you to change it, and replace it in case of a breach.

7. Rules of conduct

By using the App you agree not to:

• falsify results with tricks, automated programs, emulators, modifications of the App or any means other than your own play;
• use more than one account to improve your position in the leaderboard or in challenges;
• harass other players, for example with repeated and unwanted friend requests or challenges;
• get around the technical limits of the App, access other people's data, interfere with the service or overload it;
• reverse engineer, copy or distribute the App, except as permitted by law;
• generate artificial views or taps on ads, alone or with the help of other people or programs;
• use the App for commercial or unlawful purposes.

8. Results, levels and leaderboards

• Every round is validated automatically by our servers. A round may turn out not validated (for example because of too many pauses or timings that do not fit the game) or under review: in these cases it does not count for leaderboards and levels. If you think this is a mistake, write to us.
• Levels depend on the rounds you pass. Each day, beyond a certain number of rounds of the same game, further rounds do not move you up a level.
• The leaderboard is weekly, the same for all players (not by age), and only counts validated training rounds.
• The winner of a challenge is decided automatically by comparing the scores. A challenge that is not played expires after 7 days.
• Scores, levels and positions have no economic value, give no right to prizes and cannot be exchanged.
• We may change games, scoring rules, levels and leaderboards to improve the App or fix errors, and cancel results obtained through errors in the service or in breach of these Terms.

9. Friends, invites and challenges

You can search for other players by nickname, send friend requests, share an invite link and challenge other players. The invite link expires after 7 days and shows your nickname to anyone who receives it: only share it with people you know. You can remove a friend at any time; the other person is not notified. Other players are responsible for their own behavior.

Blocking and reporting. You can block a player: from then on you can no longer search for each other, send each other friend requests or challenge each other, any friendship is removed and open challenges between you are not counted. You can unblock them in Profile → Settings → Blocked players. You can also report a player who breaches these Terms (for example for an offensive nickname, harassment or falsified results): we review reports and take the measures in §13. Do not misuse reports: false reports, or reports repeated in bad faith, are a breach of the Terms.

10. Notifications

If you allow them, we send you notifications about friends, invites, challenges, service communications and messages from the Mind League team. You can turn them off at any time in Profile → Settings → Notifications or in your phone settings.

11. Intellectual property

The App, the games, the graphics, the Lumy mascot, the texts, the sounds, the trademarks and the software belong to Oglut or its licensors. We grant you a personal, non-exclusive, non-transferable and revocable license to use the App on devices you own or control, for personal and non-commercial use only, in compliance with these Terms and with the rules of the store you downloaded it from.

12. Availability of the service

We do our best to keep the App running without interruptions, but the service may be suspended for maintenance, updates, technical problems or causes beyond our control. You need an Internet connection to play. We may ask you to update the App to keep using it.

13. Suspension and closure of the account

• You can stop using the App and delete your account at any time from Profile → Settings → Delete account. Deletion is immediate and irreversible.

• In case of a breach of these Terms (for example falsified results, offensive nicknames, harassment, a false date of birth) we may, proportionately:

  • remove your results from the leaderboard;
  • replace your nickname;
  • suspend the account for a period or indefinitely;
  • close it.

  We tell you the reason with a message in the App or, if the account is suspended, on the screen you see when you open it. You can challenge the decision by writing to info@oglut.com.

• We may discontinue the Mind League service with at least 30 days' notice given in the App.

14. Liability

The App is provided free of charge and as is. To the extent permitted by law, Oglut is not liable for the loss of scores, levels or progress, nor for indirect damages arising from the use of, or inability to use, the App. This does not affect liability for willful misconduct or gross negligence, for personal injury, or the rights the law grants you as a consumer, which these Terms do not limit in any way.

15. App Store and Google Play

These Terms are concluded between you and Oglut, not with Apple or Google. Oglut alone is responsible for the App, its maintenance and support. Apple and Google have no maintenance or support obligations for the App and are not responsible for claims relating to the App, for example on product liability, compliance with legal requirements or infringement of third-party rights. If the App does not conform to an applicable warranty you can notify Apple, which, to the extent permitted by law, has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a United States embargo and that you are not on any list of parties to whom the provision of services is prohibited. The usage rules of the store you downloaded the App from also apply.

16. Changes to the Terms

We may change these Terms, for example for new features or changes in the law. We notify you in the App at least 15 days before important changes take effect and, when necessary, ask you to accept them again. If you do not accept them you can delete your account.

17. Governing law and disputes

These Terms are governed by Italian law. If you are a consumer, you are in any case entitled to the protection of the mandatory rules of the country where you live, and disputes fall under the jurisdiction of the court of the place where you reside or are domiciled. Before going to court you can write to us at info@oglut.com to look for a solution, or turn to an alternative dispute resolution (ADR) body.
